Milford couple arrested for $100,000 insurance fraud

insurance fraudA Milford couple was arrested June 11 after filing $100,000 in medical insurance claims for an car accident that never happened.
Diliana Legeros, 33, and husband Joseph Aubourg, 43, were indicted by a Delaware Grand Jury June 4 for insurance fraud and arrested June 11 after turning themselves in to Capital Police. They were processed, arraigned and released on $1,000 unsecured bond each after the Delaware Department of Insurance found they filed insurance claims for injuries from a New Jersey car accident that did not occur.
On November 16, 2016, Legros reported an accident claim to the couple’s car insurance company, stating on November 12, 2016, Legros, Aubourg and two of their children were traveling from New Jersey to Delaware when a Mini Cooper with New York tags merged into their lane and struck their vehicle. Legros and Aubourg reported the Mini Cooper driver failed to stop but they were able to secure the car's license plate number. Despite having the tag number, neither notified the police. Aubourg, Legros and the children claimed injuries and were treated by a Milford chiropractor and other medical professionals.
After inspecting the reported striking vehicle and interviewing the vehicle owner, investigators found evidence that proved the accident never occurred. As a result of the false claims the insurance provider was billed over $100,000 in medical bills, and had paid out over $55,000 related to the claim.
Delaware’s Insurance Commissioner Trinidad Navarro stated, “We take insurance fraud seriously. Even though this incident allegedly took place in New Jersey, the defendants’ insurance coverage was in Delaware. Our fraud investigators acted on information they received, and did a thorough follow up investigation that ultimately led to these arrests.
